Prenuptial and Postnuptial Agreements

Couples decide to enter into marital contracts like these for a variety of reasons. In the case of prenuptial agreements, questions about the rights and obligations concerning whatever assets each individual brings into the marriage and also regarding the assets acquired during the marriage are important.

Settling these kinds of questions before the marriage vows are even taken is not a fatalistic approach. Nearly half of all marriages do end in divorce. It is good planning, much easier, more predictable, and a less expensive solution to plan those issues in advance rather than litigating them later.

Postnuptial agreements are usually put into place before some type of major change in either of the spouse's lives occurs. One spouse may be planning to invest significant assets in a new business venture that their partner believes to be risky. In this case, the couple may decide how to allocate their assets and liabilities while remaining married to one another.
